Sending a notice of claimed infringement
To be effective under 17 U.S.C. 512(c)(3), your notice must be in writing and include all of the following:
- A physical or electronic signature of the copyright owner, or a person authorised to act on their behalf.
- Identification of the copyrighted work you claim has been infringed. If several works are covered by one notice, a representative list of them.
- Identification of the material you claim is infringing and want removed, with enough detail for us to locate it. A direct URL to the page is best.
- Your name, mailing address, telephone number and email address.
- A statement that you have a good faith belief that the use is not authorised by the copyright owner, its agent, or the law.
- A statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or authorised to act on their behalf.
Incomplete notices delay things, because we may have to come back to you for the missing parts before we can act.
What we do when we receive one
We review the notice, and where it is valid we remove or disable access to the material expeditiously. We tell the person who posted it what was removed and why, and we pass on your notice so they can respond if they believe the removal was a mistake.
Counter notice
If your material was removed and you believe that was the result of a mistake or misidentification, you may send a counter notice to the agent above. Under 17 U.S.C. 512(g)(3) it must include:
- Your physical or electronic signature.
- Identification of the material that was removed, and the location it appeared at before removal.
- A statement, under penalty of perjury, that you have a good faith belief the material was removed as a result of mistake or misidentification.
- Your name, address and telephone number, and a statement that you consent to the jurisdiction of the federal court for the district where you live, or, if you are outside the United States, for any district in which Silloria may be found, and that you will accept service of process from the person who sent the original notice or their agent.
If we receive a valid counter notice we forward it to the original complainant. Unless they tell us within 10 to 14 business days that they have filed a court action seeking to restrain the activity, we may restore the material.
Repeat infringers
We keep a record of infringement notices we act on. In appropriate circumstances, and at our discretion, we terminate the accounts of users who repeatedly infringe copyright. This policy is part of our Terms of Service.
A warning about false claims
Under 17 U.S.C. 512(f), anyone who knowingly materially misrepresents that material is infringing, or that it was removed by mistake, can be liable for damages, including costs and legal fees. Please be sure the use is not fair use or otherwise authorised before you send a notice.
Reporting illegal content, and how to reach us
Copyright is one kind of complaint. If you believe something on Silloria is illegal for another reason, you can report it from the content itself: every post, video, review, comment and profile has a report control, and choosing "Illegal content" asks you to explain why. We confirm we have received your report, review it, and tell you what we decided.
If you would rather write to us, or you are a public authority contacting us about content or an order, use info@silloria.com. That address is our single point of contact for both users and authorities, and we accept correspondence in English.
Where we remove or restrict something, we tell the person who posted it what we did, why, whether any automated system was involved, and how to challenge it.
Trademarks and other complaints
Fragrance names, brand names and associated trademarks belong to their respective owners, and we refer to them to identify the products we write about. If you have a trademark concern, or any other complaint about content on Silloria, write to info@silloria.com with the details and a link, and we will look into it. Reporting controls for other kinds of content are described in our Terms of Service.
